{"id":1,"date":"2025-02-05T18:37:33","date_gmt":"2025-02-05T18:37:33","guid":{"rendered":"https:\/\/rhinowebllc.com\/ljones-cfa\/?p=1"},"modified":"2025-02-25T22:08:03","modified_gmt":"2025-02-25T22:08:03","slug":"importance-of-evidence-integrity","status":"publish","type":"post","link":"https:\/\/rhinowebllc.com\/ljones-cfa\/2025\/02\/05\/importance-of-evidence-integrity\/","title":{"rendered":"Importance of Evidence Integrity"},"content":{"rendered":"\r\n<p><span style=\"font-weight: 400;\">We\u2019ve all seen courtroom dramas\u2014whether it\u2019s <\/span><i><span style=\"font-weight: 400;\">12 Angry Men<\/span><\/i><span style=\"font-weight: 400;\">, <\/span><i><span style=\"font-weight: 400;\">To Kill a Mockingbird<\/span><\/i><span style=\"font-weight: 400;\">, or <\/span><i><span style=\"font-weight: 400;\">The Lincoln Lawyer<\/span><\/i><span style=\"font-weight: 400;\">\u2014and let\u2019s be real, the best part is usually when someone catches a witness in a lie or convinces a juror to change their vote. But you know what they don\u2019t show? The thrilling, nail-biting process of introducing evidence into a trial. Yeah, didn\u2019t think that would keep you on the edge of your seat. But here\u2019s the thing: getting evidence into the trial is super important\u2014without it, the jury can\u2019t even consider it when making their decision.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">So, what makes evidence admissible? Well, the lawyers can agree that an item of evidence is okay to be presented (a little &#8220;peace treaty&#8221; between the sides). If they don\u2019t agree, the judge steps in and must decide if it\u2019s good to go. And how does the judge make that call? The big factor is <\/span><b>evidence integrity<\/b><span style=\"font-weight: 400;\">\u2014basically, making sure that the evidence hasn\u2019t been tampered with, changed, or mysteriously &#8220;lost&#8221; between the crime scene and the courtroom. If it\u2019s been altered in any way (even if it was just an accidental facepalm moment), that could totally mess up its credibility. We\u2019re talking about proving that the evidence you have today is the same thing you picked up yesterday\u2014no changes, no damage, no sneaky tricks.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">To keep things straight, investigators rely on something called <\/span><b>chain of custody<\/b><span style=\"font-weight: 400;\">. Think of it as a super official diary tracking who\u2019s had the evidence at all times\u2014like, &#8220;Hey, I\u2019ve got the phone now, and I\u2019m not letting it out of my sight!&#8221; The chain of custody ensures that no one\u2019s been playing around with the evidence. If there\u2019s a break in the chain, it\u2019s like the evidence went rogue, and suddenly, everyone\u2019s suspicious. Without a solid chain of custody, lawyers on the other side might as well have a field day claiming your evidence is a hot mess. Not great for your case.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">In short, the chain of custody is like the <\/span><i><span style=\"font-weight: 400;\">superhero<\/span><\/i><span style=\"font-weight: 400;\"> of the courtroom. It saves the day by proving your evidence is legit and hasn\u2019t been tampered with. It\u2019s basically the legal version of a high five to integrity.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Now, as a digital forensic examiner, I have collected evidence a lot of times\u2026 and more often than I\u2019d like, I\u2019m handed a phone with absolutely <\/span><i><span style=\"font-weight: 400;\">zero<\/span><\/i><span style=\"font-weight: 400;\"> chain of custody documentation. It\u2019s like, &#8220;Hey, here\u2019s this phone we just found lying around\u2014good luck!&#8221; In over half of my cases, I get a mobile phone from a law firm representative\u2014not the owner, not the custodian, but from someone like an attorney\u2019s assistant or the receptionist at the front desk. I can start the chain of custody from there, but let\u2019s be real: I can\u2019t vouch for what happened to that phone before it made its way into my hands. If opposing counsel gets wind of that, they\u2019re going to have a field day, and suddenly, your receptionist could become the most important witness in your case. Yikes.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Check out the picture below of an actual example of how a phone was transferred to me from a law firm. Looks official, right?\u00a0 As you can see, I\u2019ve tried to protect the innocent.<\/span><\/p>\r\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-3210 size-full\" src=\"https:\/\/rhinowebllc.com\/ljones-cfa\/wp-content\/uploads\/2023\/02\/ljones-evidence.png\" alt=\"\" width=\"392\" height=\"427\" srcset=\"https:\/\/rhinowebllc.com\/ljones-cfa\/wp-content\/uploads\/2023\/02\/ljones-evidence.png 392w, https:\/\/rhinowebllc.com\/ljones-cfa\/wp-content\/uploads\/2023\/02\/ljones-evidence-320x349.png 320w\" sizes=\"auto, (max-width: 392px) 100vw, 392px\" \/><\/p>\r\n<p><span style=\"font-weight: 400;\">Now, do you think opposing counsel is going to be <\/span><i><span style=\"font-weight: 400;\">totally chill<\/span><\/i><span style=\"font-weight: 400;\"> with evidence that sat on a desk for hours (or days!) without anyone keeping track of it? Spoiler: probably not. If you care about preserving and analyzing that device, here\u2019s my totally professional and 100% serious advice to keep the chain of custody solid:<\/span><\/p>\r\n<ol>\r\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Document when and where the device is received<\/b><span style=\"font-weight: 400;\">: Record the date, time, and who handed it over. Consider assigning one person to take care of all your digital evidence. Don\u2019t make it a free-for-all.<\/span><\/li>\r\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Snap pics of the device<\/b><span style=\"font-weight: 400;\">: Show it in its natural state. If it\u2019s a phone, capture the make, model, and serial number. Think of it as the \u201cevidence glamour shot.\u201d<\/span><\/li>\r\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Lock it up<\/b><span style=\"font-weight: 400;\">: Don\u2019t leave it lying on a desk like it\u2019s a forgotten coffee cup. Put it in a secure location, like a locked drawer or a safe.<\/span><\/li>\r\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Hands off the device<\/b><span style=\"font-weight: 400;\">: If it\u2019s off, don\u2019t turn it on. If it\u2019s on, consider giving it a little charge to keep it alive. But whatever you do, no funny business\u2014don\u2019t let your curiosity get the best of you.<\/span><\/li>\r\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Pass it to the expert pronto<\/b><span style=\"font-weight: 400;\">: Don\u2019t waste time. Get that device into the hands of a forensic examiner ASAP. Let them deal with the evidence integrity drama.<\/span><\/li>\r\n<\/ol>\r\n<p><span style=\"font-weight: 400;\">And finally, if you can manage it, have the owner or custodian hand the device directly to the forensic examiner.
